These terms cover your use of Destin. Using the app means you accept them, together with our Privacy Policy and our Community Guidelines, which are part of these terms.
Who can use Destin
You must be at least 18 years old to use Destin. Destin is about bars, nightlife and going out, and many of the venues it covers are for adults only. We do not ask for proof of age, so this is something you confirm about yourself when you use the app. Do not use Destin, and do not let anyone use it, if they are under 18.
Your account
Keep your login details to yourself, and tell us if you think someone else has them. You are responsible for what happens under your account. Do not impersonate anyone else or claim to be connected to a venue you have no connection to.
What you post
You keep ownership of your reviews, photos and comments. By posting them you allow us to store and display them inside Destin so the people you have chosen can see them. You are responsible for having the right to post what you post.
Zero tolerance for objectionable content
There is no tolerance for content that harasses, threatens, degrades or sexualises anyone, for hate speech, or for content that targets a person for who they are. The same applies to abusive behaviour toward other people using the app.
We review reports and remove content that breaks these rules. Accounts that do it can be suspended or removed without notice.
Reporting and blocking
Every post, comment and profile can be reported from inside the app, and any account can be blocked. The Community Guidelines explain what happens after a report.
Your safety
Destin helps you find places and see where your friends have been. It is not a safety tool. We do not verify anyone's identity, we do not run background checks on the people you meet through it, and we are not an emergency service. If you meet someone from Destin, use your judgment: meet in public, tell a friend where you are going, and contact your local emergency number if you are ever in danger. Going out, and meeting people, is at your own risk.
Events and ambassadors
Some accounts, which we call ambassadors, can create events in Destin. This is a permission we grant, there is no way to sign up for it yourself, and it is unpaid today. We may change how events and ambassadors work, including adding paid or compensated roles, at any time.
Where Destin works
Destin currently covers the San Francisco Bay Area. Venues and events outside that area are not supported. This may change over time.
Paid features in the future
Destin is free today. We may add paid features, subscriptions, or compensated roles later. If we do, we will make the terms of anything paid clear before you pay for it, and using the free parts of Destin will not commit you to any of it.
Accuracy of venue information
Venue details, opening hours and event information come from other people using Destin and from outside sources, and we cannot promise they are accurate or current. Check before you travel.
The app is provided as is
Destin is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or that the app will be uninterrupted, secure or error free. You use Destin at your own discretion and risk.
Limitation of liability
To the fullest extent the law allows, Paladin Technologies and the people who make Destin are not liable for any indirect, incidental, special or consequential loss arising from your use of the app, or from anything that happens between you and another person you meet through it. Nothing in these terms limits any liability that cannot be limited by law.
Your responsibility to us
You agree to cover us for claims, losses and costs that arise from your misuse of Destin, from content you post, or from your breaking of these terms.
Copyright
If you believe content on Destin infringes your copyright, email us at minka@dstn.app with enough detail to identify the work and where it appears, and we will review it and remove infringing content where appropriate. We may remove content and suspend accounts that infringe repeatedly.
Suspension and appeals
We may remove content, or suspend or close an account, if it breaks these terms or the Community Guidelines, or puts other people at risk. If you think we acted in error, email us at minka@dstn.app and we will look again.
Ending it
You can delete your account at any time from Settings, and you can stop using Destin whenever you like. We may suspend or close an account as described above.
If you use Destin on an Apple device
These terms are between you and Paladin Technologies, not Apple, and Apple is not responsible for Destin or its content. Apple has no obligation to provide any maintenance or support for Destin. If Destin ever fails to meet a warranty that cannot be disclaimed, you may tell Apple, and Apple may refund any price you paid for the app, which is currently nothing; beyond that refund, Apple has no warranty obligation for Destin. We, not Apple, are responsible for handling any claim relating to Destin, including product liability claims, claims that it fails to meet a legal requirement, and claims under consumer protection or privacy law, as well as any claim that Destin infringes someone else's intellectual property. By using Destin you confirm that you are not located in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You can reach us about Destin at minka@dstn.app.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be handled by the courts located in Delaware, unless the law where you live gives you the right to use your local courts.
If part of these terms fails
If any part of these terms is found unenforceable, the rest stay in force.
Changes
We may update these terms. If a change is significant we will say so in the app, and we will update the date at the top. Questions go to minka@dstn.app.
